A Justiça Eleitoral de Carpina julgou improcedente a ação de investigação judicial movida pela coligação Esperança de um Futuro Melhor (União e PSB) contra Eduarda Gouveia, candidata a prefeita nas eleições municipais de 2024 pela coligação Carpina Pode Mais. A decisão foi proferida nesta segunda-feira (3) pelo juiz André Rafael de Paula Batista Elihimas, da 20ª Zona Eleitoral.
A ação acusava Eduarda Gouveia e seu vice, Eraldo José do Nascimento, de abuso de poder econômico e de comunicação, compra de votos, uso de servidores públicos e disseminação de informações falsas contra adversários. Segundo a denúncia, os investigados teriam distribuído combustíveis em eventos de campanha, perfurado poços artesianos em troca de apoio político e patrocinado cirurgias e doações de materiais de construção para obter votos.
O magistrado, no entanto, concluiu que nenhuma das acusações foi comprovada. Parte das provas apresentadas pela coligação adversária foi considerada ilícita, como gravações e áudios obtidos sem autorização judicial. Além disso, o juiz destacou que o grupo autor não apresentou testemunhas em audiência para confirmar as denúncias.
Em relação à distribuição de combustíveis, a decisão apontou que o ato foi realizado dentro dos limites legais previstos pela Resolução nº 23.607/19 do Tribunal Superior Eleitoral (TSE) — até 10 litros por veículo, com nota fiscal registrada na prestação de contas da campanha. Já a perfuração dos poços artesianos foi comprovadamente executada pelo DNOCS, órgão federal, sem qualquer vínculo com os investigados.
Sobre as supostas fake news contra o ex-prefeito Joaquim Lapa, o juiz afirmou que não houve comprovação de que os fatos divulgados eram falsos nem de que houve uso abusivo de recursos financeiros para disseminá-los.
Com base nessas conclusões, a Justiça Eleitoral julgou improcedentes todos os pedidos da coligação Esperança de um Futuro Melhor, mantendo os direitos políticos de Eduarda Gouveia e determinando o arquivamento do processo após o trânsito em julgado, sem custas nem honorários.
