O vereador, advogado animalista e pré-candidato a deputado estadual Anderson Correia(PP/UP) segue acompanhando o caso da cadela morta de forma cruel em um posto de combustível no bairro Santa Clara, em Caruaru, na última sexta-feira (31), que gerou revolta e indignação na população. O animal foi atingido por um golpe de espada desferido por um homem que, apesar da gravidade do crime, não permaneceu preso após ser apresentado à delegacia.
De acordo com o parlamentar, o agressor “livrou o flagrante”, ou seja, o crime já havia ocorrido e o suspeito não foi detido no momento do ato ou logo depois, o que impede a prisão imediata pela autoridade policial. A Constituição Federal, no artigo 5º, inciso LXI, estabelece que “ninguém será preso senão em flagrante delito ou por ordem escrita e fundamentada de autoridade judiciária competente”. Assim, sem flagrante, a prisão depende de decisão judicial.
Correia explicou que, nesses casos, a investigação é conduzida pela Polícia Civil e, posteriormente, o Ministério Público oferece a denúncia. Durante o processo, o juiz pode determinar a prisão preventiva, conforme prevê o artigo 312 do Código de Processo Penal (CPP), quando houver risco de fuga, ameaça à vítima ou testemunhas, repetição do crime, ou perigo à ordem pública.
Diante da grande comoção que o caso gerou na sociedade caruaruense, Correia informou que está protocolando um pedido ao Ministério Público para que seja solicitada a prisão preventiva do autor do crime, de forma a garantir a continuidade das investigações com segurança e assegurar que a justiça seja feita. “Não podemos permitir que um ato tão cruel fique impune. Seguiremos lutando para que haja justiça e para que crimes contra animais sejam tratados com a seriedade que merecem”, destacou.
