A Comissão de Defesa dos Direitos das Pessoas com Deficiência (CPD) da Câmara dos Deputados aprovou, nesta terça-feira (15), o Projeto de Lei nº 1762/2025, de autoria do deputado federal e segundo-secretário da Casa Lula da Fonte (PP-PE). A proposta garante prioridade na restituição do Imposto de Renda para mães, pais ou responsáveis legais de crianças e adolescentes neuroatípicos, como pessoas com Transtorno do Espectro Autista (TEA) e TDAH. O objetivo é assegurar que essas famílias, que enfrentam despesas contínuas com tratamentos, terapias e educação especializada, possam ter acesso mais rápido aos recursos a que têm direito.
“A proposta é uma medida de justiça e sensibilidade com quem já enfrenta tantos desafios no dia a dia. Estamos falando de famílias que precisam de apoio real. A restituição do IR pode parecer simples para alguns, mas para quem tem gastos permanentes com medicamentos, terapias e educação adaptada, esse valor faz muita diferença”, afirmou o deputado.
O texto foi aprovado pela relatora, deputada Dayany Bittencourt (União-CE), que ampliou o alcance da medida para beneficiar também os responsáveis legais por pessoas com deficiência (PCD), sem limite de idade, e por indivíduos com transtornos de aprendizagem, como dislexia e outros. A relatora destacou que o projeto preenche uma lacuna legal, já que, atualmente, apenas o contribuinte com deficiência tem direito à restituição prioritária, e não seus responsáveis, que arcam com a maior parte das despesas.
A relatora também ressaltou que a proposta está alinhada com legislações como a Lei Berenice Piana e o Estatuto da Pessoa com Deficiência, além de princípios constitucionais de proteção à infância e dignidade humana.
Com a aprovação na CPD, o projeto segue agora para as comissões de Finanças e Tributação e de Constituição e Justiça e de Cidadania (CCJC), onde será analisado em caráter conclusivo. Caso não haja recurso para votação em plenário, a proposta poderá seguir direto para o Senado. A expectativa é que a nova regra entre em vigor já no exercício seguinte à sua publicação.
