A deputada federal Missionária Michele Collins (PP-PE), atualmente na suplência, é a autora de um projeto de lei que representa um importante avanço na garantia dos direitos das mulheres no serviço público. O PL 3221/24, de sua autoria, foi aprovado nesta quinta-feira (03), na Comissão de Defesa dos Direitos da Mulher da Câmara dos Deputados. A iniciativa propõe que candidatas grávidas remarquem o teste de aptidão física previsto em concursos públicos.
A proposta visa corrigir uma situação recorrente de exclusão e desigualdade: a eliminação de mulheres gestantes por não poderem realizar testes físicos no momento exato determinado pelo edital. “Nossa intenção é garantir que a maternidade não seja um obstáculo para o ingresso da mulher no serviço público. É uma questão de justiça e de respeito aos direitos fundamentais”, defendeu Michele Collins.
O texto aprovado na comissão é um substitutivo apresentado pela relatora, deputada Delegada Ione (Avante-MG), que incorporou a proposta ao Regime Jurídico dos Servidores Públicos. A medida, contudo, mantém o foco na ideia central concebida por Collins: assegurar que a gestação não seja tratada como um impedimento para a carreira pública.
Para usufruir do direito à remarcação do teste físico, a candidata deverá apresentar laudo médico e exame laboratorial que comprovem a gravidez. A nova data deverá ser compatível com o período pós-gestação, assegurando condições equânimes de avaliação física.
A proposta, no entanto, delimita que o benefício não se aplicará a provas orais, discursivas, psicotécnicas ou etapas que não exijam esforço físico. “É inadmissível que, ainda hoje, mulheres sejam prejudicadas por exercerem sua maternidade. Precisamos mudar essa realidade e ampliar direitos”, afirmou a deputada Michele Collins, que possui histórico de atuação em pautas sociais e de defesa da mulher tanto no Recife quanto em Brasília.
