Presidente Lula sanciona projeto de lei de Luciano Bivar sobre nova chance para réu antes de cobrança de indenização

O presidente da República, Luiz Inácio Lula da Silva, sancionou o Projeto de Lei 2812/2023, proposto pelo deputado federal Luciano Bivar (União Brasil-PE). Com a sanção, foi adicionado ao art. 499 da Lei nº 13.105, de 16 de março de 2016 (Código de Processo Civil), um parágrafo que permite ao réu cumprir a tutela específica, antes de ser obrigado a pagar indenização ao autor da ação.

Essa mudança na legislação oferece uma nova oportunidade para que o réu execute as ordens determinadas pelo juiz antes de ser compelido a indenizar o autor da ação. Isso se aplica em situações onde o tribunal ordena, por exemplo, que uma pessoa ou empresa substitua um produto com defeito ou forneça um serviço específico.

O deputado federal Luciano Bivar expressou gratidão ao governo Lula pela rápida aprovação de projetos significativos como esse, destacando sua relevância para o programa habitacional ‘Minha Casa Minha Vida’. Ele enfatizou que essa medida contribuirá para reduzir o número de ações judiciais e oferecerá ao réu a oportunidade de reparar o dano ou indenizar o autor. Isso, por sua vez, desencorajará a chamada “indústria de ações” praticada por escritórios de advocacia clandestinos.

O deputado Bivar foi recebido no Palácio do Planalto pelo Ministro das Relações Institucionais, Alexandre Padilha, que elogiou a alteração na lei, destacando sua importância para garantir um ambiente mais seguro e favorável para os consumidores e as seguradoras nos negócios.
