O grave acidente envolvendo uma visitante do recém-inaugurado parque aquático Acquaventura, na Praia dos Carneiros, acendeu o alerta sobre os riscos enfrentados por consumidores em atrações com alto impacto e limitação de peso. Jaqueline Nascimento, vítima do incidente, relatou nas redes sociais ter sido “lançada para fora da montanha-russa aquática”, sofrendo cortes no rosto e hematomas após a boia da atração perder o controle.
O deputado estadual Romero Albuquerque lamentou o ocorrido, expressou solidariedade à vítima e cobrou medidas imediatas para reforçar a segurança em estabelecimentos do tipo. “É inadmissível que, em pleno 2025, consumidores ainda corram risco de vida por falhas básicas de segurança”, destacou o parlamentar.
Uma das medidas de segurança, por exemplo, está estabelecida na Lei nº 17.198/21, de autoria de Romero, em vigor desde 2022. Ela alterou o Código Estadual de Defesa do Consumidor para obrigar parques aquáticos e similares a verificarem o peso dos usuários antes do acesso a equipamentos com limitação de carga. A norma também exige a instalação de placas informativas com os limites de peso e prevê sanções rigorosas em caso de descumprimento.
Para o deputado, o caso expõe não apenas a falta de assistência, mas também a ausência de protocolos eficazes. “O que aconteceu no parque poderia ter terminado em morte. A falha é grave: a atração exigia duas pessoas por boia, mas não houve controle ou orientação adequada. A vítima foi exposta ao risco por falta de informação e de fiscalização. A responsabilidade é do parque, e os órgãos de fiscalização devem agir com urgência”, disse.
Após a repercussão do caso, outros visitantes relataram acidentes semelhantes nas redes sociais. Uma mulher fraturou a clavícula e precisará passar por cirurgia. Outro casal relatou forte impacto e escoriações ao cair de uma boia.
Romero destacou que o momento exige atuação firme do poder público para evitar tragédias. “Não podemos esperar o pior para agir. A lei existe, está publicada, e os parques tiveram tempo para se adaptar. Agora é papel do Procon e dos demais órgãos de fiscalização fazerem valer essa legislação e outras medidas previstas no Código de Defesa do Consumidor. Segurança não é favor — é direito”, afirmou.
Ainda nesta segunda-feira, o deputado encaminhará um pedido de informações ao Governo do Estado sobre a aplicabilidade da Lei nº 17.198/21 e de outros instrumentos de proteção ao consumidor em parques aquáticos e estabelecimentos similares.
