Uma nova ferramenta digital que o Conselho Nacional de Justiça (CNJ) disponibilizou na internet, nesta terça-feira (14), realça dados sobre a realidade do sistema brasileiro de atendimento a adolescentes que cumprem medidas socioeducativas por decisão judicial.
O novo painel contém informações colhidas durante as inspeções que magistrados realizam periodicamente em unidades de ressocialização. Conforme os dados disponíveis, relativos a 427 estabelecimentos de internação fiscalizados nos meses de setembro e outubro de 2024, havia, em todo o país, na ocasião, 10.423 adolescentes cumprindo medidas socioeducativas.
Desse total, 34% desses meninos e meninas tinham 17 anos de idade. A grande maioria (9.976) do sexo masculino se declara parda (55%), seguidos por pretos (19%) e brancos (25%). Ao menos 37 têm filhos, 27 apresentam alguma deficiência física e 1.134 foram diagnosticados com algum tipo de transtorno mental.
De cada dez unidades de internação, quatro (39%) garantiam mais de 20 horas semanais de estudo, enquanto 37,1% ofereciam entre 16 horas e 20 horas semanais. Ao menos 406 unidades dispunham de assistente social entre seus funcionários, e 403, de psicólogos. O total de agentes socioeducativos identificados chegava a 18.127 pessoas e o Sistema Nacional de Atendimento Socioeducativo (Sinase), como um todo, tinha capacidade para atender a até 18.406 jovens que cometeram atos infracionais.
Responsável por, entre outras coisas, promover o controle e a transparência sobre as ações do Poder Judiciário no Brasil, o CNJ assegura que o Painel de Inspeções no Socioeducativo facilitará o acesso dos interessados às informações sobre o Sinase. O próprio órgão reconhece que os dados colhidos durante as inspeções vinham sendo atualizados com pouca regularidade, dificultando que fossem usados para o aprimoramento de políticas públicas e pesquisas.
A iniciativa também atende a recomendações da Comissão Interamericana de Direitos Humanos (Cidh) e da Organização das Nações Unidas (ONU), que destacam a importância da coleta regular de informações sobre o sistema socioeducativo a fim de garantir que o Estado garanta o cumprimento dos direitos dos adolescentes.
O Estatuto da Criança e do Adolescente (ECA), por exemplo, estabelece que adolescentes com alguma doença ou transtorno mental devem receber tratamento individual e especializado, em local adequado às suas condições. E que, sempre que possível, o Judiciário deve optar por aplicar medidas em meio aberto, como prestação de serviço à comunidade e liberdade assistida, em detrimento das restritivas de liberdade, sendo a internação em unidade exclusiva para adolescentes aplicável apenas nos casos previstos em lei por ato infracional cometido mediante grave ameaça ou violência a pessoa; repetição no cometimento de outras infrações graves e/ou descumprimento reiterado e injustificável da medida anteriormente imposta.
O painel do CNJ permitirá aos interessados consultar os dados por unidade federativa e sobre temas como óbitos, suicídios, bem como sobre a estrutura das unidades de internação e/ou internação provisória e o perfil dos profissionais que atuam no Sinase. Também há informações sobre a população LGBTQIA+, além do acompanhamento detalhado das inspeções realizadas.
De acordo com o CNJ, a ferramenta substituirá o Cadastro Nacional de Inspeções em Unidades e Programas Socioeducativos (Cniups), criado em 2022, para permitir que juízes e juízas registrassem os achados das inspeções às unidades.
